Governor Perry has issued at least three controversial executive orders:
* Fast tracking coal plants .
* Requiring schools to spend to spend 65 Percent of their budget on "direct instruction"
* Requiring HPV Immunization for girls' entrance to 6th grade
These orders have led to an examination of the powers of the governor to issue "executive orders." Sen. Nelson has asked the attorney general for an opinion on the governor's authority to issue "executive orders."
Update in the TXU cases: On February 20, 2007, Judge Stephen Yelenosky granted a temporary injunction that directed the State Office of Administrative Hearings to discontinue its adherence to Rick Perry's Executive Order that fast-tracked the permit process. Hearings on 6 of TXU's proposed power plants were set to begin February 21.
On February 21st, the administrative law judges, released from the confines of the executive order, postponed the TXU hearings until June 27th. Between now and then, the parties will have more opportunities to conduct discovery and prepare their cases.

PERRY FAST-TRACKED THE COAL POWER PLANTS
REPEAL HIS EXECUTIVE ORDER
In October 2005, Perry issued the order that fast-tracked the 18 proposed coal-plants. Six applications are being pushed through the State Office of Administrative Hearings, on a ridiculously truncated schedule that is a heavy burden on all those without the TXU billions to participate. If Perry repeals the order, there is a chance that the hearings could resume a normal schedule that allows due process for all Protestants. The legislature needs to take action.
